Welcome to Baja Adventures. These Terms and Conditions govern your use of the website https://www.bajaadventures.com. By accessing and using our website, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our website.

  • Use of the Website
    You agree to use the website in accordance with all applicable laws and regulations. You also agree not to:

    • Use the website for any unlawful or unauthorized purpose.

    • Impersonate any person or entity, or falsely state or otherwise misrepresent yourself.

    • Attempt to interfere with or disrupt the proper functioning of the website.

  • Privacy
    Your use of the website is also governed by our Privacy Policy. By using the website, you consent to the practices described in our Privacy Policy, which can be found on our site.

  • Intellectual Property

  • Changes to the Website and Terms
    We reserve the right to modify or discontinue the website or any part thereof with or without notice. We may also modify these Terms at any time, and the updated version will be posted on the website. Your continued use of the website after such changes constitutes your acceptance of the modified Terms.

  • Governing Law
    These Terms and your use of the website shall be governed by and construed in accordance with the laws of Mexico without regard to its conflict of law principles.

    Multi-Day Expeditions:

  • A 50% deposit is required to confirm your booking for any experience; the remaining 50% must be paid 60 days prior to arrival. The initial 50% deposit is non-refundable and non-transferable as these funds secure essential services such as boats and accommodations.

  • CANCELATIONS made by guests more than 60 days prior to arrival will incur a cancellation fee of 50% of the total booking amount (during local public holidays this fee increases to 100%).

  • CANCELATIONS made by guests within 60 days prior to arrival will incur a cancellation fee of 100% of the total booking amount.

  • Please be advised that the second, third and forth payment, constituting 75% or 50% of the total booking cost, must be received within the specified time frame outlined in your payment schedule. If the payments are not made within 7 days following the due dates, Baja Adventures reserves the right to cancel your booking without refund. Timely payment is essential to secure your reservation.

    One day adventures:

  • A 50% deposit is required to confirm your booking for any shared experience; the remaining 50% must be paid 60 days prior to arrival. The initial 50% deposit is non-refundable and non-transferable as these funds secure essential services such as boats and accommodations.

  • CANCELATIONS made by guests:

    • 50% Refund up until 15 days before your adventure.

    • 25% Cancellation fee up until 7 days before your adventure.

  • No refund up until 6 days before your adventure.

  • Please be advised that the second payment, constituting 50% of the total booking cost, must be received within the specified time frame outlined in your payment schedule. If the second payment is not made within 7 days following the due date, Baja Adventures reserves the right to cancel your booking without refund. Timely payment is essential to secure your reservation.

    Important Notes for any booking or cancelation by participants or Baja Adventures:

  • By paying your deposit, you accept these Terms and Conditions.

  • All payments made via bank card will incur an additional 5% fee (bank fees).

  • All bank transfers must follow our banking instructions (the client is responsible for all bank transfer charges).

  • If you or anyone in your party cancels for illness or family emergencies, we cannot refund any payments or deposits.

  • Refunds will be issued based on amounts received; please note that bank conversion rates may vary and discrepancies due to these rates or bank policies are not our responsibility.

  • If a trip cannot proceed due to major force events (e.g., pandemics), payments are non-refundable but can be rescheduled based on client availability.

  • Control-Related Cancellations: If we cancel a trip for reasons within our control, you will receive a full refund for all amounts paid to us.

  • Unforeseen Circumstances: In cases of cancellation due weather conditions, natural disasters, political unrest, or other unforeseen events beyond our control, we will reschedule your adventure or exchange for another one.

  • Mental state: Participants appearing intoxicated will not be allowed to join and will lose their payment in full.

  • Non-attendance: Not showing up or arriving more than 30 minutes late will result in a last-minute cancellation with no refund issued.

  • Waiver of liability: Participants must complete a liability waiver form before starting activities; refusal results in a last-minute cancellation with no refund.

  • Tips for guides/captains are not included in stated prices and must be given in cash.

  • Stated prices do not include taxes.

  • We are not responsible for any additional costs incurred as a result of cancellations, including flight changes, ticket fees, or lost vacation time.

Intermediate Dealer Responsibilities for Baja Adventures:

In engaging in business with Baja Adventures, you understand and agree to the following responsibilities:

  1. Guest Agreement:
    You will ensure that all of your guests have agreed to the retail terms and conditions found on our website.

  2. Booking Authority:
    You are acting on behalf of your guests in making bookings for them.

  3. Information Provision:
    You will be responsible for informing your guests of all information and documentation required by government authorities and Baja Adventures.

  4. Documentation Submission:
    You will obtain the necessary information and documentation from your guests and provide it to us within the established timelines.

  5. Compliance with Regulations:
    Ensure that all bookings comply with local laws and regulations, including those related to safety and environmental protection.

  6. Communication:
    Maintain clear communication with your guests regarding any changes to their bookings or relevant policies that may affect their experience.

  7. Customer Service:
    Provide excellent customer service to enhance the overall experience for your guests, addressing any concerns or questions they may have prior to or during their adventure.

  8. Feedback Collection:
    Encourage guests to provide feedback about their experiences, which can help improve our services and offerings.

    *By agreeing to these responsibilities, you acknowledge that you will earn a commission based on your bookings.
